INTERNATIONAL ARBITRATION AND LEGAL EXPERIENCE
An arbitrator's subject-matter expertise is important, and arbitrators add value and efficiency when their work is interdisciplinary.
Disputes rarely occur in a silo, and disputes rarely adhere to the nicities of subject-matter boundaries. A dispute involving energy production, for example, will undoubtedly involve a range of subject areas, whether in environmental law, public-private partnerships and procurement regulations, antitrust, subsidies, commercial contracts, health and safety, criminal, or even employment law. Likewise, an employment dispute may involve issues related to reasonable accommodations, commercial contracts, fraud, tax, or wage and hour concerns. All of these disputes will involve further procedural, due process, and/or evidentiary complexities.
Regardless of who is appointed, that arbitrator will need to be able to identify, address, and manage each of these complex issues.
Even where disputes do not involve the immediate subject matter of other disciplines, they can benefit from the dispute resolution tools that have been developed elsewhere. Just as international commercial and investment disputes have their foundations in the procedures that were developed for US labor disputes, domestic mass claims arbitrations can benefit from the document exchange processes that were developed to facilitate international matters.
